Donald Trump is not forgiving or forgetting about the “Access Hollywood” video leak that sent both his presidential campaign and Billy Bush’s career into a spiral.

When appearing on Fox News’ “The O’Reilly Factor” Thursday night, Trump described the release of the 2005 hot mic tape in which he bragged about inappropriately groping and kissing women — including Nancy O’Dell — as “an illegal act” and suggested that he might take legal action against NBC.

When asked by host Bill O’Reilly if he would “currently be ahead [in the polls] if not for the ‘Access Hollywood’ stuff?’ Trump said that he “just doesn’t know.”

“It was very negative, it was locker room talk. The microphone was not meant to be on — not that I make that as an excuse for myself — but certainly it was an illegal act,” he said. “That was NBC, it was not meant to be on. That was a private dressing room.”

O’Reilly then asked if he will take any action after the election against the network after the election.

“You’ll see, you’re going to see after the election,” Trump replied. “We are going to find out sooner enough, I will tell you.”

This is far from the first time Trump has threatened to sue someone, however, California has a “two-party consent” law, making it a crime to record or eavesdrop on any confidential communication, including a private conversation or telephone call, without the consent of all parties to the conversation.
